Article 6.2 a)

Modify the article to read :

When an employee has to be withdrawn from his occupation al classification following a technological change in his occupation*, following a partial factory closure causing the elimination of his post, following an organizational change, he has the right, before being laid off, to be trained for an existing vacant position, provided he meets one of the following conditions:

i)     qualified to do the job;

b)    has previously performed a part of similar work to that of the vacant position in question.

After a minimum periocl of up to four (4) weeks of the aforementioned training has elapsecl, the employee must show that he will be able to meet the l'8quirements of the job in question.

If the Company decicles that the employee is not qualifiecl to follow the training or he failecl cluring the training periocl, the company sha11 give him the reason of their decision. ln case of grievance, the company will bear the onus of proof.

b) The employee who cannot be assigned to another post in the bargaining unit will be laid off for shortage of work and, if he so wishes, according to Article 6.3 b) ii) his name will appear on a recalllist, same duration as Article 4.14, headed "employees laid off according to section VI" and he has the right to be trained for an existing vacant position, provided he meets one of the following conditions:

  i) qualified to do the job.

 ii)   has previously performed a part of similar work to that of the vacant position in question;

After a minimum period of up to four (4) weeks of the aforementioned training has elapsed, the employee must demonstrate that he will be able to meet the requirements of the job in question.

If the Company decides that the employee is not qualified to follow the training or he failed during the training period, the Company shall give him the reasons of their decision. ln case of grievance, the company shall assume the onus of proof.

Working conditions

Article 7.1 b) Modify the article to read

As much as possible, the Company will schedule the work so that it will be accomplished during the first work shift. ln the case where it is necessary to schedule work on the other shifts, seniority by occupational classification or by modular occupation is the determining factor, taking aIs a into account the ability to accomplish the work in question when the time cornes for an employee ta exercise this choice when the vacancy of a position occurs.

Where a position is c10sed on a given shift, the concerned employee will be able, depending on his seniority, ta choose from which existing shift he may replace another employee with less seniority.

The parties agree that it is difficult to foresee aU possible situations in the administration of this article. ln such case, it must have an agreement between the parties.

#10             Article 7.4

a) Hourly-rated employees reporting for work who have not been advised in advance not to report and for whom work is not available shall be paid for 4 hours at straight time rates. Exceptions to this will be when employees are prevented from working because of power failure and/or such similar circumstances beyond the Company's control. The Company will not be held to this obligation where an employee has failed to advise the Human Resources of current changes in address and/or telephone number.

Notwithstanding the provisions contained in paragraph 8.2 an employee is remunerated for such a day of observance of a statutory holiday:

If he was absent the last regular working day preceding the said statutory holiday due to EMERGENCY illness at home, death in the immediate family or has obtained prior permission from the Company to be absent on such a day.

#19    Article 17.2 Modify the article to read :

#20    Article 18.2 Absence for birth or adoption

An employee may be absent from work for five (5) regular days at the hirth of his child, the adoption of a child or where there is a termination of pregnancy in or after the twentieth week of pregnancy. The first two days of absence sha11 be remunerated if the employee is credited with sixt y days of uninterrupted service.

This leave may be divided into days at the request of the employee. It may not be taken more than fifteen days after the child arrives at the residence of his father or mother or after the termination of pregnancy.

The employee must advise his employer of his absence as soon as possible.

However, an employee who adopts the child of his spouse may be absent from work for only two days, without pay.

#21    Article 18.4 New Family leaves

An employee may be absent from work, without pay, for ten (10) days pel' year to fulfil obligations relating the care, health or education of the employee's spouse, father, mother, brother, sister or one of the employee's grandparents.

The leave may be divided Ü1to days. A day may also be divided if the employer consents thereto.

The employee must advise the employer of his absence as soon as possible and take the reasonable steps within his power to limit the leave and the duration of the leave.

An employee who is credited with three months of uninterrupted service may be absent from work, without pay, for a period of not more than 12 weeks over a period of 12 months where he must stay with his spouse, the child of his spouse, his father, mother, brother, sister or one of his grandparents because of a serious illness or a serious accident.

An employee must advise the employer as soon as possible of an absence from work and, at the employer's request, furnish a document justifying the absence.

However, if a minor child of the employer as a serious and potentially mortal illness, attested by a medical certificate, the employee is entitled to an extension of the absence, which shall end at the latest 104 weeks after the beginning thereof.

Duration of the collective agreement

#24    Article 26.1 Modify the article to read :

This agreement will become effective on March 27th, 2006 and will remain in effect for a period of three (3) years, terminating March 26th 2009, unless modified by mutual consent of the parties hereto.

#25    Letter of Intent # 16 - Social delegate

Modify the last paragraph to read:

Every year, an assessment will be made by the Union and the Company in order to estimate the social stewards' needs to ensure the proper functioning of his services.

#26    Letter of Intent #18 -

·         Considering that the work of the modular occupation assembler has been limited to mechanical assembly and runner balancing.

• Considering that the workload of this occupation may be sporadic.

·  Considering a surplus of work that may occur in certain maintenance occupations.

· The parties agree that in the case of a drop in the workload in the assembly occupation, that the employer may assign one or more assemblers to the mechanical maintenance (031) or general maintenance (033) occupations respecting the following conditions:

· no layoffs or elimination of positions may exist in these occupations (031 and 033);
· the assignment must be of a minimum of five (5) days;

· the employer must prove to the union that there is a true shortage of work in the assembly occupation;

·the employer must advise the union five (5) working days prIor to the beginning of the transfer and the estimated duration;

·  the choice of the transferred employee will be made on a voluntary basis and / or by seniority. The chosen employee is considered as a temporary transfer;

· the transfer period begins the first day of the first transfer during the year, and the duration should not exceed eight (8) months during a period of one year;

·at the expiration of the eight (8) month period the transferred employee returns to his occupation (019) and the position in question must be posted according to article 9.5 of the present collective agreement as a new position caused by an increase of employees in the concerned occupation (031 and 033);

· the employer will limit overtime in the assembly occupation (019) during transfers to the maintenance occupations (031 and 033) and this overtime, if any, will not exceed the number of hours in a regular work weel<:.

ADDENDA
MODULAR OCCUPATION

#27   MACHINIST - MACHINE SHOP

1) Training

Practical training will be do ne through the concept of rotation.
Opportunity for training will be granted taking into consideration the seniority of employees and the needs of production.

2) Transfer

The transfer from one module to the next will be voluntary.

3) Wage progression

The increases within the same module will be granted every six months. The module is made of three levels with a minimum and a maximum (representing the fourth level). The gap between the minimums and maximums is 15%

The change from one module to the next will be made after the evaluation of the knowledge and skills of the employee.

The new employees will be classified in their module at the level corresponding to their abilities and skills.

MACHINIST - MACHINE SHOP

GENERIC ABILITIES / KNOWLEDGE AND PROGRESSION (MODIFIED)

#5 New Letter of Intent Note 6 - Welder-Chipper

Addition to the salary scale

For employees working as welders (050) and chipper (009) who do during their own work, a preliminary verification by penetrant inspection shall receive a 0,50 $ per hour premium added to their salary.

InternaI training shaH be given to these employees in order that they be able to accomplish this task.

#6 New - Letter of intent - "Programming"

The employee, worbng as machinist (045) or modelmaker (044), who is volunteer to occasionally do programming of hydraulic profile and who is qualified to do programming 3 axes simultaneous sha11 receive an additional premium of 5%. The Company shall make a rotation amongst qualified employees in order to conserve their abilities.

ln case of refusaI on the part of the employee, the premium shall be cancelled. After a six-month (6) period, the qualified employee can again obtain his premium providing he accepts to make programming occasionally as mentioned in the above paragraph.

#7  New - Letter of Intent - Working clothes

The Company will supply, without charge, working clothes ta a11 employees, including a cleaning and distribution service.

 #8 New - Letter of Intent - Glasses with prescription or Prescribed Glasses

The Company shall pay, once per year, an amount of $100 per employee to coyer the cost of glasses which are prescribed on presentation of a written proof.

WAGES

#10 Hourly salary rate

The regular salary rates applicable from March 27th 2006 to March 26th 2009, are listed by occupation in Appendix A.

Raise on March 27th

1st year  = 3%

2nd year = 2,38%

3rd year = 2,4%

 

This raise is applied at the base and maintains a difference 15% with the maximum.

#11   Cost of living allowance

Effective in 2007

a)  ln September 2007, a cast of living indemnity with no maximum will be granted and added ta the salary at the rate of 1 cent pel' each .135 points increase in the Consumer Price Index (1981 = 100) from August 2007 relative to the index of May 2007.

b) ln December 2007, a cast of living indemnity with no maximum will be granted and added ta the salary at the rate of 1 cent pel' each .135 points increase in the Consumer Price Index (1981 = 100) from November 2007 relative to the index of August 2007.

ln order to answer to the employees preoccupations, in the case where G.E. Canada, in the course of our Collective Agreement 2006-2009, would modify in more favourable terms (the unfavourable terms won't be applied for the duration of Collective Agreement) the work conditions and/or Social Benefits listed below, the Company work agrees to implement then for the employees, members of Local Lodge 1660:
